Collecting Personal Information
We collect Personal Information from applications, questionnaires, and other forms you submit to us, such as your name, contact information (address, email, and telephone number). We also collect information from your transactions and interactions with us, such as your driving report settings.
We may access public sources of information, such as census data, and private sources of information such as market research data to append the data to a user profile. Note: our Web sites may be hosted by a third party service provider on servers located in the United States. If you are located in a non-US jurisdiction, you may be sending your Personal Information to the United States or another jurisdiction that does not have laws that provide an equivalent level of data protection to the laws in your home country.
Cookies and Other Tracking Technologies
Technologies such as: cookies, beacons, tags and scripts are used by DriveFactor and our analytics or service providers. These technologies are used in analyzing trends, administering the site, tracking users’ movements around the site and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.
As is true of most websites, we gather certain information automatically and store it in log files. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data. The IP address may not be the IP address of your personal computer, but the IP address assigned to your Internet connection by your Internet service provider or company network. We also may collect aggregate search terms from search engine referrals to determine what information visitors are searching for when they find our websites.
We do not link this automatically collected data to other information we collect about you.
Third parties with whom we partner to provide certain features on our site or to display advertising based upon your web browsing activity use LSOs such as HTML 5 to collect and store information.
We use mobile analytics software to allow us to better understand the functionality of our mobile software on your phone. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and where the application was downloaded from. We do not link the information we store within the analytics software to any personal information you submit within the mobile app.
We partner with a third party to either display advertising on our website or to manage our advertising on other sites. Our third party partner may use technologies such as cookies to gather information about your activities on this website and other sites in order to provide you advertising based upon your browsing activities and interests. Collecting Personal Driving Data
In addition to collecting personal information, DriveFactor will collect data about your driving habits from electronic devices, such as the DriveFactor telematics devices and certain cellular telephone applications. Such data may include the number of miles you drive, the way you drive including your turning, acceleration, braking, and other driving characteristics, the times of day you drive, and the places you drive.
When you download and use our services, we automatically collect information on the type of device you use, operating system version, and the device identifier.
We also collect your location-based information for the purpose of scoring your driving habits. . We will only share this information with our mapping provider for the sole purpose of providing you the service.
You may opt-out of location-based services at any time by editing the setting at the device level or by emailing us at firstname.lastname@example.org.
We may occasionally send you push notifications through our mobile applications to send you game updates, high scores and other service related notifications that may be of importance to you. You may at any time opt-out from receiving these types of communications by turning them off at the device level through your settings.
Using personal driving data
Personal driving data is necessary for the performance of DriveFactor services including creating and displaying driving reports and providing feedback to help you drive more safely. If you purchase auto insurance from one of DriveFactor’s partner insurance companies and receive a discount for being a DriveFactor customer, DriveFactor will share certain personal driving data with that insurance company including, for example, the total miles you drive and the DriveFactor Safe Driving Score. DriveFactor will never, however, share data about where you drive or where your car is parked with any insurance company or other third party without your explicit permission, except as required by law.
Using Personal Information
Personal Information collected from you is often necessary for the performance of the services and functionalities offered on our website. Information gathered from Web-based tools may be used to (i) administer and improve our websites and your user experience, by gathering statistical information about how our website is used, and diagnosing any technical problems which may occur with our servers; and (ii) identify individual users who have registered for certain products, and track their online activities, including their registration, submissions, and information requests, in accordance with applicable law.
Co-Ownership of Personal Information
When signing up with an insurance carrier or by consenting to share with an insurance carrier, we will share your personal information with that carrier. We share this information so that the insurance carrier can provide discounts on your auto insurance to you. This sharing will continue until you contact either your insurance carrier or DriveFactor. If you discontinue sharing your personal information you will no longer have the ability to receive auto insurance discounts.
Use By Third Parties
If you submit personal information to us as part of a request to be contacted by insurance companies, driving instructors, or other third parties, we will supply your personal information to them, and they will use the information you have provided to contact you regarding the specific product which you have requested. We do not have control over the use of your personal information once we provide it to them and we are not responsible for their privacy practices. Your rights with respect to their treatment of your information will be governed by their own policies.
Disclosing Personal Information
We will share your personal information with third parties only in the ways that are described in this privacy statement. DriveFactor may disclose personal information to third parties as required or permitted by law, under the following circumstances:
- To companies and individuals with whom we contract to perform business functions and services on our behalf, e.g., hosting our web servers, analyzing data, providing legal, accounting and marketing services, and providing other support services,
- To government agencies, advisors, and other third parties in order to comply with applicable laws, law (e.g., in response to subpoenas or government investigations), to assert or defend legal claims, and in order to investigate or respond to actual or suspected illegal activities, fraud, and threats of physical harm, or to protect the rights or property of DriveFactor

These service providers are authorized to use your personal information only as necessary to provide these services to us;
- If DriveFactor is in negotiations to be acquired by or merged with another company. You will be notified via a prominent notice on our website of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.
Your Opt-Out Choices
With respect to personal information, you have the ability to opt out of certain types of information sharing and communications. You may tell us not to:

- Solicit you by mail, telephone or e-mail for products and services that are not directly related to your account and that are outside our regular communications with you (such as your monthly statement, customer service e-mails or when you call our customer service center). If you tell us not to solicit you, we will not disclose information about you within our corporate group of companies for that purpose. You may opt out of receiving these communications and information when you create your DriveFactor account by following the instruction for opting out of the communication programs. If you receive an email from us you may opt out of further email communications by following the opt-out link contained in the email.
Please note that your decision to opt out will not apply to certain disclosures that are required for us to deliver the products you have ordered or that are specifically permitted or required by law. Your general opt-out instructions will not apply to specific disclosures or communications to which you consent.
Personal Data Security and Confidentiality
We have up-to-date physical safeguards, such as secure areas in buildings; electronic safeguards, such as passwords, internal and external firewalls, and encryption; and procedural safeguards, such as customer authentication procedures to prevent ID theft. Information you provide to us when you register for and order our products is transmitted to us through a secure sockets layer (SSL) transmission. We restrict access to information about you to only those employees who need to know that information to provide products or services to you. We carefully select and monitor outside service providers, such as mail vendors, who have access to customer information, and we require them to keep it safe and secure. We do not allow them to use or share the information for any purpose other than the job they are hired to do. By using the contact information below, DriveFactor will provide you access to personal information about you in accordance with applicable law, so you can correct or delete the personal information. You may have additional rights in non-U.S. countries, such as objecting to and blocking the processing of your personal information. For security reasons, DriveFactor will take steps to authenticate your identity before providing you with access to personal information. We will respond to any requests for access within 30 days.
We will retain your information for as long as your account is active or as needed to provide you services. Please contact us if you wish to cancel your account or request that we no longer use your information to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
